FedRAMP High vs. FISMA High ATO: What’s the Difference?

FedRAMP and FISMA are related, but not interchangeable. Both sit on the same NIST 800-53 High baseline — but FISMA is the umbrella law that says every federal system needs an Authority to Operate (ATO), while FedRAMP is the cloud-specific program built on top of it. A FedRAMP High ATO includes everything FISMA High covers, then adds cloud-specific controls, an independent third-party (3PAO) assessment, and ongoing continuous monitoring. A FISMA-High ATO on its own doesn’t come with any of that.

So when two vendors both say “High” on their security page, this is the difference worth digging into.

What FISMA actually covers

The Federal Information Security Modernization Act is the law underneath all federal system security. It tells agencies to categorize their systems under FIPS 199 prescribed categories (Low, Moderate, or High), apply the matching NIST 800-53 control set, assess those controls, and issue an ATO before anything goes live. “FISMA High” just means a system was categorized at High impact and authorized against the NIST 800-53 High baseline through an agency’s own internal process. This applies to every federal system — on-premise, hybrid, or cloud, it doesn’t matter.

What FedRAMP adds on top

FedRAMP takes that same FISMA foundation and standardizes it specifically for cloud. On top of the NIST High baseline, a FedRAMP High assessment adds cloud-specific controls (things like multi-tenancy, boundary definition, and shared responsibility with the infrastructure provider), an assessment done by an accredited third party (3PAO) instead of a vendor just self-attesting, standardized paperwork (an SSP built on FedRAMP’s own templates), and mandatory continuous monitoring with a set reporting schedule. The end result is a package built to be reused across agencies — which is really the whole point of FedRAMP existing in the first place.

Why they both get to say “High”

Because they’re both graded on the same scale: FIPS 199 categorization feeding into the NIST 800-53 High baseline. The impact level just describes how sensitive the data is — it doesn’t tell you which program actually did the testing. That shared label is exactly why two “High” claims can look identical on paper while meaning very different things underneath.

What this actually means if you’re buying an EHR (or telehealth platform)

Picture two cloud EHR vendors. Vendor A says “FISMA High ATO.” Vendor B says “FedRAMP High ATO.” Vendor A went through one agency’s internal process — that’s real, but it may not include cloud-specific controls, an independent 3PAO review, or FedRAMP-grade continuous monitoring. If a second agency wants to use that system, they’re largely starting from scratch. Vendor B was assessed against the full FedRAMP High baseline — cloud controls, independent assessment, ongoing monitoring, all of it — which gives a second agency something they can actually lean on instead of re-assessing everything themselves. For cloud systems, FedRAMP High is the more complete credential, and per the FedRAMP Authorization Act of 2022, it’s also the framework the government actually requires for cloud services touching federal data.

The High label isn’t the whole story — what matters is what got tested

Here’s a nuance worth knowing: the strength of an authorization comes from what was actually assessed, not just which name is on the certificate.
