Your privacy is very important to VSee Lab, Inc. (“Us”, “VSee”). We are committed to conducting our business in accordance with the following principles to ensure the confidentiality of personal information is protected and maintained.

What Personal Information Does VSee Collect?

VSee Lab, Inc. collects personally identifiable data during account creation and when the user submits information while using the product. This data includes:

  • Data you provide you create a VSee account, such as your name and email address.
  • Data you provide or generate when you use your VSee account, such as your VSee chat message history, usage history, and crash analysis data.
  • For VSee Clinic users only: We store only the scheduling information, medical history, photos and notes that you enter into the VSee Clinic application.
  • For VSee Clinic providers only: We store scheduling information and the information you and your users enter into the VSee Clinic application.

How Does VSee Share Personal Information With 3rd Parties?

Legal
VSee Lab, Inc. may share personal information if we believe in good faith that we are required to do so in order to comply with an applicable statute, regulation, rule or law, a subpoena, a search warrant, a court or regulatory order, or other valid legal process.. VSee Lab, Inc. may also share personal information if we need to do so to protect or defend our legal rights, or those of our users. VSee Lab, Inc. may disclose personal information in special circumstances when we have reason to believe that disclosing this information is necessary to identify, contact or bring legal action against someone who may be violating our contractual obligations and rights, to detect fraud, or to protect the safety and/or security of our users.

Merger or acquisition
In the event that VSee Lab, Inc. is sold or merges with another organization, we may need to share your personal information with a potential buyer. From time to time, we may also share your personal information with members of our group of companies, for example, if we were reorganizing our business.

Vendors
VSee Lab, Inc may share your information with 3rd party vendors who provide support to our services for our products.

Additional Information
The health care applications of VSee Lab, Inc. collect patient data and this data is provided to authorized medical practitioners.  This is only done with the consent of the patient and this data is covered by HIPAA regulations.

VSee Lab, Inc. DOES NOT disclose personal information to non-authorized third parties, except where required by law. This includes selling, renting, trading, sharing, or giving information via any medium. VSee Lab, Inc will transmit personal health information to authorized medical providers.  This is only done with prior consent of the patient.

How Does VSee’s Website Use Cookies?

We use data collection devices such as “cookies” on certain pages of our website to help facilitate your use of our website. “Cookies” are small files placed on your hard drive that assist us in providing access to our website and services

Cookies may be set by the site you are visiting (“first-party cookies”) or by a third party, such as those who provide analytics or interactive content on the site (“third-party cookies”). Our website uses cookies from third parties that we partner with or which provide services to us.

Personal Information Collected and Purposes of Use
VSee Lab, Inc. collects and use information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, to you or your devices when you visit our Websites, provide us your personal information, or have a contractual or business relationship with us or any of our customers, (“Personal Information”).

We collect Personal Information for the purposes identified in the section above called: “What Personal Information Does VSee Collect?”. We may have shared your Personal Information with the categories of third parties identified in the section above called: “How Does VSee Share Personal Information With 3rd Parties?”.

Unless specifically stated, we do not share, disclose, or sell personal information to third parties for their use, but we do share your personal information with our trusted partners to support our business. In these arrangements, the use of the information we share is limited by policies, contracts, or similar restrictions.

Your Privacy Rights under California Law
Californians have the following rights regarding our collection and use of your personal information. We may ask you to provide additional information to verify your request.  Californians have the right to request the information regarding the personal information we have collected, sold, or disclosed about you.  This policy explains the:

  • Categories of personal information collected about you, and sources from which collected;
  • Our purpose for collecting personal information;
  • Categories of third parties with which the personal information was shared; and
  • Specific pieces of personal information collected about consumers.
  • Categories of your personal information sold in the preceding 12 months;

Right to Opt-out
Californians have the right to opt-out of sharing, disclosure, or sale of your Personal Information.  To exercise this right, you or your authorized representative may submit a request by emailing us at privacy@vsee.com.

Right to Request Deletion
Californians have the right to request that we delete the personal information we have about you. However, we are not required to delete information if it is necessary to retain your information to:

  • Complete the transaction for which the personal information was collected, provide a good or service requested by you, or a transaction reasonably anticipated within the context of our or one of our affiliate’s ongoing business relationship with you, or to otherwise perform a contract we have with you.
  • Detect security incidents, protect against malicious, deceptive, fraudulent or illegal activity or prosecute those responsible for that activity.
  • Debug to identify and repair errors that impair existing intended functionality.
  • Exercise free speech, ensure the right of another consumer to exercise his or her right of free speech, or exercise another right provided for by law.
  • Facilitate solely internal uses that are reasonably aligned with your expectations based on your relationship with us or one of our affiliates.
  • Comply with a legal obligation.
  • Otherwise use the personal information, internally, in a lawful manner that is compatible with the context in which it was provided.

Nevada Considerations

If you reside in Nevada, our use of your information is governed by Nevada law. This section applies only to Nevada residents.

Personal Information Collection and Purposes of Use
We collect certain personal information of Nevada consumers as identified in the section above called: “What Personal Information Does VSee Collect?”.We collect this personal information for the purposes identified in the section above called “How Does VSee Use the Personal Information It Collects?”.

Your Privacy Rights
You have the right to access and correct your personal information or opt-out of the sale of personal information. If you would like to review, correct, or update your personal information, you or your authorized representative may submit your request to privacy@vsee.com.  We will respond to your verified request as soon as reasonably practicable, but no later than sixty (60) days after receipt. If circumstances cause any delay in our response, you will be promptly notified and provided a date for our response.

We generally do not disclose or share personal information for profit. Under Nevada law, you have the right to direct us to not sell or license your personal information to third parties. To exercise this right, if applicable, you or your authorized representative may submit a request to privacy@vsee.com.  We will respond to your verified request as soon as reasonably practicable, but no later than sixty (60) days after receipt. If circumstances cause any delay in our response, you will be promptly notified and provided a date for our response.

Privacy Shield

VSee Lab, Inc. complies with the EU-U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce. While VSee Lab, Inc. does not use the Privacy Shield as a mechanism of transfer for personal information from the European Union to the United States, VSee Lab, Inc. has certified to the Department of Commerce that it adheres to the Privacy Shield Principles.  To learn more about the Privacy Shield program, and to view our certification, please visit https://www.privacyshield.gov/.

In compliance with the Privacy Shield Principles, VSee Lab, Inc. commits to resolve complaints about our collection or use of your personal information.  Individuals with inquiries or complaints regarding our Privacy Shield policy should first contact VSee Lab, Inc. at privacy@vsee.com.

VSee Lab, Inc. has further committed to refer unresolved privacy complaints under the Privacy Shield Principles to an independent dispute resolution mechanism, the BBB EU PRIVACY SHIELD, operated by the Council of Better Business Bureaus. For EU individuals if you do not receive timely acknowledgment of your complaint, or if your complaint is not satisfactorily addressed, please visit http://www.bbb.org/EU-privacy-shield/for-eu-consumers for more information and to file a complaint.

Under certain conditions, more fully described on the Privacy Shield website, you may invoke binding arbitration before a Privacy Shield Panel when other dispute resolution procedures have been exhausted.

How Does VSee Protect Your Personal Information?

VSee protects the confidentiality and integrity of your personal information by using encryption mechanisms on all servers hosting data. Personal information is only transmitted using FIPS-validated cryptographic mechanisms.

VSee Lab Inc. complies with relevant laws and regulation to allow individuals to exercise the rights that they may have in their personal information. In order to exercise the rights you may have, you can contact us at privacy@vsee.com.  There are more details in the sections below.

GDPR Data Rights for Residents of the EEA, UK , or Switzerland?

If you reside in the European Economic Area (EEA), the United Kingdom, or Switzerland, our use of your personal information is governed by the European Union’s General Data Protection Regulation, or “GDPR” or applicable EEA, UK or Swiss national laws. These grant you particular rights in your personal information, including the right to alter, correct, receive, or delete personal information processed by VSee Lab, Inc. subject to our business interests and any legal requirements we may face.

Those in the EEA, UK, or Switzerland have the right to complain to a data protection authority about our collection and use of your personal information. Data Request and Rights

If you need further assistance regarding your rights, please contact us privacy@vsee.com and we will consider your request in accordance with applicable law. In some cases, our ability to uphold these rights for you may depend upon our obligations to process personal information for security, safety, fraud prevention reasons, compliance with regulatory or legal requirements, or because processing is necessary to deliver the services you have requested. Where this is the case, we will inform you of specific details in response to your request.

Notice: Transfers of Your Personal Information Outside the EEA, UK and Switzerland

VSee Lab, Inc. is based in the United States and we process and store information in the U.S. Therefore, we and our service providers will store and access your personal information in the U.S.  The U.S. may not provide equivalent levels of data protection as enjoyed in your home jurisdiction.

Changes To This Policy

VSee Lab, Inc. reserves the right to modify this Privacy Policy at any time as changes in circumstance, laws, and regulations may necessitate changes to this policy. Changes and clarifications will take effect immediately.
